1. HOW WE CAN HELP: Linerud Law Firm has successfully represented clients from all areas of Oregon and Washington at the Appeals Council and District Courts. Linerud has also represented clients before the Agency and conducted hearings throughout the country, including in California, Alaska, Arizona, Colorado, Wyoming, Montana, North Dakota, Nevada, New Mexico, Missouri, Oklahoma, New York, Florida, Georgia, Texas, and Idaho. In addition, Linerud has prepared appellate briefs at the request of other attorneys in the 8th and 10th Circuits. Linerud’s representation of Social Security clients has spanned more than two decades;
2. FEES: Linerud Law Firm is only seeking to be compensated by way of attorney fees pursuant to EAJA (Equal Access to Justice Act). The EAJA fee is paid by the government and does not come out of your client’s past-due benefits. Specifically, you will retain all §406(a) fees awarded by SSA. You will also collect any §406(b) fees, if and when available. The only fee we seek is the EAJA award;
3. TEAMWORK: Linerud Law Firm is willing to coordinate or collaborate with you regarding the pursuit of benefits at the Appeals Council and/or Federal Court at your request. We will also keep you apprised of any outcomes or significant events immediately;
4. CLIENT RETENTION: When you make a referral to our office for appeal, you are not giving up representation of the client and continue your representation before the Social Security Administration, (unless you elect to discontinue represenation). For this reason, at the Appeals Council, we could be co-counsel. As Attorney or Representative of record, you would continue to receive documents regarding your client’s claim. Similarly, in Federal Court cases outside of Oregon and Washington, we could be co-counsel in those jurisdictions that require co-counsel as part of Pro Hac Vice requirements. Following the conclusion of the appellate proceedings, we will redirect the client to you for further proceedings and/or payment; and
5. TIME AND COMMITMENT: A Federal Court case demands 30-40 hours of an experienced attorney’s time. We are available and willing to devote the time and attention to detail that is necessary to provide quality work, and obtain a successful outcome for you and your client.
